Terms of Service
Payments are non-refundable placement fees
Each of the seven weekdays is a ranked list of advertisers. When you pay, you purchase a non-refundable fee for a rank on one day, determined solely by the amount paid. The highest amount on a day occupies rank 1 and appears at the top of the homepage on that weekday.
Your placement is not removed by another party’s payment. If someone pays more than the amount holding a given rank, they occupy that rank and every advertiser below moves down one position. You retain a placement at your new rank for the life of the campaign, as defined below.
Your fee is not refunded when your rank changes, and it does not accrue. The amount you paid determines only the rank it bought at the time it was paid. Improving your rank later requires a new, separate payment.
You will only be charged for placements actually made. If a day cannot be sold to you — for example because you already hold rank 1 on it — it is removed from your order and your card is not charged for it.
What you are buying: a recurring weekly display placement at a rank on one weekday, for the life of the campaign.
What you are not buying: a placement of any fixed or perpetual duration, any guaranteed rank, any guaranteed number of views or clicks, any SEO benefit (all outbound links are marked sponsored nofollow), exclusivity, or any commercial outcome.
Bidding and ranking
Bidding on every day is open continuously, including while that day is the one on screen; a rank may therefore change at any time. Rank is determined by amount paid, highest first; where two amounts are equal, the earlier payment ranks higher. Payments cannot be retracted. Minimum increments are described in the rules.
The campaign, and how long a placement lasts
“The campaign” means the period during which we operate outdated.lol and display the seven weekdays. A placement lasts for the life of the campaign: your rank holds until another advertiser pays more than the amount holding it, and it is not otherwise removed while the campaign is running.
The campaign has no fixed end date and no guaranteed minimum duration, and nothing here is a promise of a perpetual, permanent or lifetime placement. We may end the campaign at any time, for any reason. We will give at least 30 days’ notice by email to the addresses on file for each advertiser holding a placement. When the campaign ends, all placements end with it. Fees already paid are not refunded and are not pro-rated, whether the campaign ends the week after you pay or years later. If that is not a risk you want, do not bid.
Advertiser identity and warranty of authority
Advertisers are identified by the website address or social handle they submit; there are no accounts and we do not verify ownership of it. You warrant that you own or are authorised to represent the identity you submit and that you hold the rights to the logo you link to and the copy you submit. Submitting an identity updates the stored brand details associated with it for future placements; placements already paid for retain the details they were purchased with. If you believe your identity has been misused, contact us and we will remove the placement.
Right to reject or remove
We may reject or remove any advertiser at any time. If we remove a placement because you broke the content policy, no refund is due. If we remove a placement for any other reason, we refund the affected fee on a pro-rata basis.
Content licence and public record
You grant us a licence to display your name, logo and tagline, including in our own marketing. Payments, amounts, ranks and advertiser names are published as a public record and remain public for the life of the campaign; we also retain them afterwards where accounting or tax law requires it.
Service availability
No uptime guarantee is offered. If the site is unavailable for more than four hours of a weekday you hold, we will offer an additional appearance rather than a cash refund.
Limitation of liability
Our total liability to you is limited to the amount you paid for the placement in question.
Changes
We may change these terms with 30 days’ notice. Bids already placed are honoured under the terms in force when they were placed.
Who you are contracting with
These terms are between you and outdated.lol. Charges appear on your statement as OUTDATED.LOL, and you can reach us at support@outdated.lol or through the contact form.
Governing law
These terms are governed by the laws of the State of Florida, and the courts of the State of Florida have exclusive jurisdiction over any dispute arising from them.
